This Privacy Statement (hereinafter “Privacy Statement”) applies to the personal data we collect and process through our website: https://www.konsilanto.be. It contains important information about how and for what purposes we collect and process personal data, and explains the rights you can exercise as a data subject. We are committed to protecting your (personal) data with the utmost care and to processing it only in a fair and lawful manner in accordance with the provisions of the GDPR, including all current national or international laws or regulations implementing the GDPR or future laws or regulations replacing the GDPR (hereinafter collectively referred to as “Applicable Data Protection Laws”).

If the processing of your personal data, as indicated in the table above, is a legal or contractual requirement, or a requirement necessary to enter into a contract, you are required to provide the personal data. If you refuse to do so, we may not be able to enter into a contract with you, and our relationship will end.

3. Your rights as a data subject

Subject to the terms and conditions of the applicable data protection laws, you may exercise the following rights as a data subject:

3.1. Right of access to your personal data

The right to request access to your personal data, to request a copy of the personal data we collect about you, and to receive additional information about how we process your data.

3.2. Right to rectification

The right to have inaccurate personal data corrected or to have incomplete personal data that we hold about you supplemented.

3.3. Right to erasure (“right to be forgotten”)

The right to have your personal data deleted from our systems.
We may not always be able to comply with a request to delete your personal data due to contractual or legal obligations, for example. We will take these obligations into account when responding to your request.

3.4. Right to object

The right to object to the processing of your personal data if the processing is based on our legitimate interests or on grounds of public interest. We will cease processing unless we can demonstrate compelling legitimate grounds for continuing the processing or for the exercise of legal claims.

3.5. Right to withdraw your consent

You may withdraw your consent at any time regarding the processing of your personal data that we have collected with your consent. For example, you can unsubscribe from newsletters at any time. Subject to legitimate exceptions under the Applicable Data Protection Laws, we undertake to respond to your request within one month of receipt. We may first ask for additional information to confirm your identity and to ensure that the request is coming from you.

3.8. Right to File a Complaint

4. Recipients

We do not disclose or sell your personal data to third parties, nor do we make your personal data public, except in the following specific cases:

  • Personal data may be shared among our various branches if such a transfer is necessary to provide our products or services in accordance with the predefined purpose listed in the table above;
  • Personal data may be shared with third-party service providers to whom we have outsourced certain processing activities. In any case, they are limited to processing your personal data in accordance with our instructions, and, if necessary, a data processing agreement will be entered into to ensure that they are obligated to comply with all obligations required by the applicable data protection laws;
  • if required by applicable laws or regulations.

5. International transfer

We will comply with applicable data protection laws regarding the provision of adequate safeguards for the transfer of personal data to recipients in countries outside the European Economic Area (“EEA”).

If we transfer your personal data to a third country or international organization outside the EEA, we will ensure that your personal data is transferred to third countries that the European Commission has determined offer an “adequate” level of protection (a list of adequate third countries is available on the European Commission’s website), or, alternatively, if your personal data is not transferred to a country that offers an adequate level of protection, we will ensure appropriate safeguards are in place with the entity receiving your personal data (e.g., the EU Standard Contractual Clauses or Binding Corporate Rules, taking into account additional requirements regarding international transfers such as supplementary measures) to ensure that your personal data remains protected in accordance with the Applicable Data Protection Laws.

6. Retention of Your Personal Data

We do not retain your personal data for longer than is strictly necessary to achieve the purposes for which we received the data. Retention periods vary depending on the type of processing activity and the purpose for which the personal data was collected.

We will retain personal data that we collect based on your consent for as long as your consent remains valid.

In all cases, personal data may be retained for a longer period if there is a legal or regulatory basis for doing so, or for a shorter period if you object to the processing of your personal data and there is no longer a legitimate reason to retain it. We guarantee that your personal data will be deleted or anonymized as soon as the retention period has expired.

We retain personal data for the following periods in particular:

  • We retain customer and supplier data regarding your purchases of our services for as long as is reasonably necessary to fulfill our agreements, to comply with our legal obligations (such as accounting and tax obligations), and to resolve disputes or enforce agreements. Therefore, this personal data is retained for the duration of our contractual relationship and for 10 years thereafter.
    • Investments: Invoices for purchases that are depreciated over multiple years are retained for up to 10 years after the end of the final depreciation period.
    • Real estate: Documents relating to buildings or land are retained for 15 years, or 25 years in the case of leases subject to VAT.
    • Tax returns involving tax loss carryforwards: The accounting records for the year in which a tax loss arose must be retained for as long as the tax return in which that loss was offset can still be audited by the tax authorities.
  • We retain personnel data that we receive in connection with payroll administration or social and legal advice in accordance with applicable legal requirements, generally for up to 5 years after the end of employment.
  • Data that we process for marketing purposes, such as your subscription to our newsletter or participation in an event, will be retained for as long as you wish to receive these communications from us. You may unsubscribe or withdraw your consent at any time, after which we will no longer retain your data for this purpose.
  • We do not retain application information that we receive in response to a job opening or an unsolicited application.
  • Contact information that you share with us via the contact form on the website or via email will be retained for up to one year after your inquiry or request has been resolved, unless the contact leads to further collaboration.
